1. Acceptance and service description
These Terms of Service govern access to Land Development Feasibility, including its property-analysis tools, maps, generated reports, downloads, and related services. By using the service, you agree to these terms. If you do not agree, do not use the service.
2. Informational purposes only
Reports are preliminary informational screening tools. They may summarize public GIS, zoning, flood, parcel, utility, environmental, and other third-party data. They are not a title report, survey, appraisal, permit determination, or guarantee that development is feasible.
3. No legal, engineering, or professional advice
The service does not provide legal, engineering, architectural, surveying, environmental, financial, or planning advice. You must consult the governing jurisdiction and qualified licensed professionals before acquiring property, designing improvements, applying for permits, financing a project, or making other development decisions.
4. User responsibilities
You are responsible for providing accurate property information, reviewing report limitations and citations, independently verifying material findings, and using the service lawfully. You may not interfere with the service, bypass access or payment controls, scrape the service at scale, submit malicious content, or misrepresent a report as a professional certification.
5. Payments
Prices are displayed before checkout and charged as one-time payments in U.S. dollars unless stated otherwise. Payments are processed by Stripe. You authorize the displayed charge and represent that you are permitted to use the selected payment method. Applicable taxes may be added where required.
6. Refund policy
Because each report is a personalized digital product made available promptly after payment, completed purchases are generally non-refundable after report access is granted. We will review requests involving duplicate charges, failure to unlock a purchased report, or a material technical defect. Submit a request to hello@landdevelopmentfeasibility.com within seven days of purchase and include the order number. This policy does not limit rights that cannot be waived under applicable law.
7. Intellectual property and permitted use
The website, software, design, analysis methods, and original report presentation are owned by or licensed to Land Development Feasibility and are protected by applicable intellectual-property laws. After purchase, you may use and share the report for your internal evaluation and with advisers working on the identified property. Third-party data remains subject to its source terms and attribution requirements.
8. Third-party sources
The service depends on governmental systems and other third-party APIs. Source data may be delayed, incomplete, unavailable, inaccurate, or changed without notice. A “verified” designation means the application matched information to an identified official source; it does not guarantee that the source itself is error-free or legally controlling.
9. Availability and changes
We may update, suspend, or discontinue features to maintain security, accuracy, or performance. We do not guarantee uninterrupted availability. We may revise these terms by posting an updated effective date. Continued use after a revision means you accept the revised terms.
10. Disclaimer and limitation of liability
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, or non-infringement. Land Development Feasibility will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost opportunities; property-acquisition costs; design or permitting expenses; or reliance on third-party information.
To the fullest extent permitted by law, total liability arising from a specific paid report will not exceed the amount paid for that report. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
11. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute must be brought in a court of competent jurisdiction in Texas, unless applicable law requires otherwise.
